Communication ethics concerns the creation and evaluation of goodness in all aspects and manifestations of communicative interaction. Because both communication and ethics are tacitly or explicitly inherent in all human interactions, everyday life is fraught with intentional and unintentional ethical questions—from reaching for a cup of coffee to speaking critically in a public meeting. Thus ethical questions infuse all areas of the discipline, including rhetoric, media studies, intercultural/international communication, relational and organization communication, as well as other iterations of the field.
Copyright is a bundle of rights granted to the creators of literary, artistic, and scientific works such as books, music, films, or computer programs. Copyright, as one of the most controversial areas of communication law and policy, has always been the subject of political contention; however, debates surrounding the subject have reached new levels of controversy since the 1990s as a result of the new formats of creative works made possible by digital media, and as a result of the new practices of authorship, creativity, consumption, collaboration, and sharing that have arisen in light of networking and social media. Technological change has not been the only driving force of change; social and political change, including changing concepts of authorship, the recognition of the rights of women and indigenous peoples, and the changing structures of international relations and international civil society, have also been reflected in copyright law. Copyright policymaking has become an increasingly internationalized affair. Forum-shifting has contributed to the proliferation of regional and international copyright policymaking forums under the rubric of stand-alone intellectual property institutions such as the World Intellectual Property Organization (WIPO), as well as under institutions dedicated more broadly to international trade negotiations.
Communication scholars and others have contributed extensively to the field of copyright and intellectual property law. Communication scholars have made significant contributions in examining the cultural significance, political economy, history, and rhetoric of copyright, drawing on diverse fields that include cultural studies and critical political economy. Communications scholars’ influence in the field of copyright scholarship has been significant.

Critical studies of humanitarian discourses involve the study of the arguments, claims, and evidence that are used to justify intervention or non-intervention in key local, regional, national, or international contexts. These discourses can take the form of arguing over whether we should practice isolationism and not intervene in the sovereign affairs of other countries, or they can take the form of deliberations over the transcend needs of populations that cope with myriad disasters. In some cases these discourses are produced by foreigners who believe that the less fortunate need to be rescued from their misery, while at other times humanitarian discourses can be used in discussions about the human rights of the disempowered. Nongovernmental organizations (NGOs), nation-states, celebrities, medical communications, and militaries are just a few of the rhetors that produce all of these humanitarian discourses.
Prejudice is a broad social phenomenon and area of research, complicated by the fact that intolerance exists in internal cognitions but is manifest in symbol usage (verbal, nonverbal, mediated), law and policy, and social and organizational practice. It is based on group identification (i.e., perceiving and treating a person or people in terms of outgroup membership); but that outgroup can range from the more commonly known outgroups based on race, sex/gender, nationality, or sexual orientation to more specific intolerances of others based on political party, fan status, or membership in some perceived group such as “blonde” or “athlete.” This article begins with the link of culture to prejudice, noting specific culture-based prejudices of ethnocentrism and xenophobia. It then explores the levels at which prejudice might be manifest, finally arriving at a specific focus of prejudice—racism; however, what applies to racism may also apply to other intolerances such as sexism, heterosexism, classism, or ageism.
The discussion and analysis of prejudice becomes complicated when we approach a specific topic like racism, though the tensions surrounding this phenomenon extend to other intolerances such as sexism or heterosexism. Complications include determining the influences that might lead to individual racism or an atmosphere of racism, but also include the very definition of what racism is: Is it an individual phenomenon, or does it refer to an intolerance that is supported by a dominant social structure? Because overt intolerance has become unpopular in many societies, researchers have explored how racism and sexism might be expressed in subtle terms; others investigate how racism intersects with other forms of oppression, including those based on sex/gender, sexual orientation, or colonialism; and still others consider how one might express intolerance “benevolently,” with good intentions though still based on problematic racist or sexist ideologies.

In the wake of what has been called “the discursive turn” in the social sciences, research at the intersection of language and communication with race and racism has shifted, from being largely dominated by quantitative and experimental methods, to include qualitative and particularly discursive approaches. While the term “discursive” potentially encompasses a wide range of modes of discourse analysis, discursive approaches share a focus on language use as social action, and as a constitutive feature of actions, events, and situations, rather than merely as a passive means of describing or transmitting information about them. When applied to the study of race and racism, such approaches have examined ways in which language functions to construct, maintain, and legitimate as well as subvert or resist racial and/or racist ideologies and social structures.
Research in these areas has made use of a range of empirical materials, including “elite” discourse (media texts, parliamentary debates, academic texts, etc.), individual interviews, group interviews or focus groups, text-based online interactions, and “naturally occurring” talk-in-interaction, from conversational and institutional settings. Specific topics examined in these studies include the construction and uses of racial subjectivities, identities, and categories; features of racist discourse(s) and their intersection with power and domination; “new” racisms, including “colorblind racism”; the production and management of accusations and denials of racism, particularly in contexts characterized by norms against racism and/or prejudice; and contestations of the nature and meanings of racism. While offering important contributions to consideration of the links between “broad” race-related social structures and their situated production and reproduction through language, the centrality of language use for these approaches has resulted in challenges relating to theorizing the relationship between discourse and materiality, and addressing non-verbal or embodied aspects of action with respect to race and racism.

The conceptualization of “culture” as a concept, as well as the degree to which “culture” is said to determine, or at least influence, our behavior, has been discussed and contested like perhaps no other concept in language and communication research since the late 20th century. Since Hofstede’s ground-breaking research on work-related values in the 1980s, scholars from a variety of disciplines have discussed how to conceptualize “culture,” how to best research it, and how to provide evidence for or against the idea of national cultures. Hofstede’s research argues that members of the same national groups have the same cultural characteristics, which makes it possible to talk about national cultures. However, more recent research argues that culture is a process that is constantly changing, and being changed, in the ongoing co-production of meaning by participants in intergroup encounters.
How and the extent to which globalization changes culture have also been discussed in recent years. Some scholars argue that globalization leads to sameness and uniformity and ultimately to the end of the nation state as we know it today. Others disagree and argue that globalization leads to a strengthening of the nation state and of the cultural values we tend to associate with it.
The importance of “culture” as an analytical concept in (intercultural) communication research is yet another pertinent topic in the literature. Some scholars have argued that the culture concept has lost its potency as a meaningful analytical concept and therefore should no longer take center stage in communication research. Others have argued that from a minority-group perspective, culture will always be salient and a determining factor for behavior.
Conflict, as part of interpersonal interactions, occurs in specific cultural settings. Viewing conflict as cultural behavior helps explain why disputes over seemingly similar issues can be handled so dissimilarly in different cultures. There have been numerous cross-cultural comparison studies of different conflict management strategies, most of them utilizing a “national culture” approach. The findings reported in the cross-cultural conflict literature point to a picture that collectivists value harmonious interpersonal relationships with others, preferring indirect or avoiding styles of dealing with conflict and showing concern for face-saving. Understanding the range of behavior choices and strategies available to manage conflict as well as differences in preferred styles adds considerably to people’s skills as effective communicators.

Research on intercultural communication is conducted using primarily three different methodological approaches: social scientific, interpretive, and critical. Each of these approaches reflects different philosophical assumptions about the world and how we come to know it. Social scientific methods often involve quantitative data collection and research approaches such as surveys and experiments. From this perspective, intercultural communication is seen as patterns of interaction, and we seek to explain and understand these patterns through clear measurement and identification of key independent variables. Interpretive methods often involve qualitative data collection and research approaches such as interviews and ethnographic observation. From this perspective, intercultural communication and meaning is created through interaction, and we seek to understand these meanings by exploring the perspectives of people who participate as members of cultural communities. Critical methods often involve qualitative data collection and research approaches such as interviews and textual critique. From this perspective, intercultural communication involves inequalities that can be attributed to power and distortions created from (mis)use of this power. Critical scholars seek to unmask domination and inequality. Most scholars utilize one of these primary approaches given the consistency with their world views, theories, and research training. However, there are creative possibilities for combining these approaches that have potential for fuller understanding of intercultural communication.

Poststructuralism represents a set of attitudes and a style of critique that developed in critical response to the growth and identification of the logic of structural relations that underlie social institutions—whether they exist in terms of politics, economics, education, medicine, literature, or the sciences. Poststructuralism should therefore not be thought of as a distinct philosophy that exists separately as its own “structure”—a proposition that would undermine its most fundamental attitudes. Rather, poststructuralism should be thought of as developing or arising only in response to pre-existing structures and, as a set of attitudes, helping us better understand, interpret, and alter our social environment by calling established meanings into question, revealing the points of ambiguity and indeterminacy inherent in any system, rejecting the rationalistic piety that all systems are internally coherent and circle around an unchanging center, showing how discourses are carriers of power capable of turning us into subjects, and placing upon us the burden of ethical responsibility that accompanies the acceptance of freedom.
Although poststructuralism by its very nature as a set of attitudes denies any attempt at comprehensive definition, this essay examines three of the major postructuralist thinkers in order to relate their thought to the study of communication. First, following Derrida, poststructuralist thought invites a critical deconstruction of any discourse that presents itself as completely coherent, centered, and rational. Poststructuralist approaches thus do not argue against a position by harnessing counterarguments drawing on a different set of principles. Rather, it deconstructs a discourse by occupying it and exposing the gaps, contradictions, paradoxes, and deferments, thus revealing its established hierarchies, binaries, logical conclusions, and principles to be far more loosely structured and poly-vocal than its advocates wish to present them. Second, following Barthes, poststructuralism refuses to locate any single point of origin of any text that can ground its meaning—particularly by pointing to some ground of the author. Although not denying that writers exist, Barthes refuses to identify the meaning of a text with the author’s biography and intentions, instead inviting multiple interpretations from the perspective of individual readers who encounter the text as a unique event. Therefore, just as discourses do not have a unified structure, neither do individual texts or the authors that produce them. Lastly, following Fouacult, poststructuralism invites an inquiry into how discourses, texts, and acts of communication are always implicated in relations of power that act upon possible actions. Following the first two propositions, poststructuralism does not analyze these relations of power as completely structured and determinate, however. Power relations are always within a dynamic relationship with acts of resistance, thereby constantly leaving space for freedom and possibility.
The concept of public culture refers most broadly to the dynamic negotiation of beliefs, values, and attitudes regarding collective association through media and other social practices that are defined by norms of open access and voluntary response. The concept is a recent innovation and applies primarily to modern societies, where public culture is the envelope of communication practices within which public opinion is formed; those practices can include news, entertainment, the arts, advertising, social media, and many other means for representing and judging any individual, institution, or custom having collective significance. The term “public” emphasizes relatively unrestricted communication across civil society regarding governance and other matters affecting the general welfare. The term “culture” emphasizes that public opinion depends on contextual factors that emerge through multiple media and embodied responsiveness. These considerations provide a basis for analysis of distinctively modern relationships across civil society, media technologies, and political action in a global context.
